Black Berry akan di blokir sementara di Indonesia

Setelah menjadi polemik antara pemerintah dan pihak RIM (Research in Motion) sejak tahun 2010 kemarin. Akhirnya pemerintah yang dalam hal ini melalui pihak Menkominfo Bapak Tifatul Sembiring.Pihak Menkminfo meng ultimatum pihak RIM dengan 7 point tuntutan. Semua tuntuan itu diminta dapat dipenuhi sebelum tanggal 21 Januari 2010,bila tidak layanan Black berry di Indonesia akan mengalami pemblokiran.

Rencana pemblokiran layanan RIM tersebut terkait dengan konten pornografi yang masih tetap bisa diakses oleh pengguna lewat ponsel BlackBerry mereka. Terhadap berbagai protes dan kecaman pedas yang ditujukan ke arahnya, lewat akun Twitternya, Tifatul berkomentar:

“Sekedar bertanya, gimana komentar rekan-rekan jika sebuah lembaga berusaha di negeri ini tapi tak mau ikuti secara utuh peraturan yang ada,” tweet Menteri Tifatul.

Undang-undang yang dimaksud Tifatul adalah UU Nomor 36 Tahun 1999 tentang Telekomunikasi, UU Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik (UU ITE), dan UU Nomor 44 Tahun 2008 tentang Pornografi.

“Harap baca pelan-pelan UU 44/2008, pasal 17. Pemerintah/pemda wajib mencegah penyebaran pornografi di masyarakat,” ucap Tifatul. “Saya hanya menjalankan undang-undang, kok disebut pembodohan. Aya-aya wae (ada-ada saja, red.). Ganti UU-nya, saya akan jalankan dengan setia,” ucapnya.

Inilah 7 hal yang diminta unutuk dipenuhi oleh pihak RIM :

Ketujuh tuntutan pemerintah adalah:

1. Pemerintah meminta RIM mematuhi peraturan perundangan yg berlaku di Indonesia, terkait dengan Undang-undang 36 tahun 1999 tentang Telekomunikasi, UU 11/2008 tentang Informasi dan Transaksi Elektronik, dan UU 44/2008 tentang Pornografi.

2. Pemerintah meminta RIM membuka perwakilan di Indonesia, mengingat sudah ada lebih dua juta pelanggan BlackBerry di Indonesia.

3. RIM juga diminta membuka pusat layanan di Indonesia untuk melayani pelanggan di sini.

4. Pemerintah ingin RIM merekrut tenaga kerja Indonesia secara layak dan proporsional.

5. RIM diminta sebanyak mungkin menggunakan konten lokal Indonesia, khususnya perangkat lunak.

6. RIM diminta memblokir situs porno, sebagaimana sudah dipatuhi oleh operator lain.

7. Pemerintah meminta RIM membangun server/repeater di Indonesia, agar aparat hukum bisa mengaksesnya.

Berdasarkan Informasi dari Vivanews.com Menurut Gatot S Dewa Broto, Kepala Pusat Informasi dan Humas Kementerian Kominfo menyebutkan Senin, 17 Januari 2011 mendatang, pihaknya akan mengadakan pertemuan dengan pihak Research In Motion. Salah satunya adalah membahas seputar filtering pornografi lewat BlackBerry.

“Sama seperti penyedia layanan lainnya, RIM juga harus comply dengan peraturan dan undang-undang yang berlaku di Indonesia, yakni melakukan filtering konten porno,” kata Gatot pada VIVAnews. “Sejauh ini, konten pornografi masih bisa diakses lewat BlackBerry,” ucapnya.

Saat Menkominfo mengungkapkan rencana untuk memblokir layanan BlackBerry, 7 Januari lalu, pemerintah menyediakan waktu 2 minggu bagi Research In Motion untuk menyesuaikan diri dengan UU yang berlaku.

“Itu berarti sekitar tanggal 21 Januari,” kata Gatot. “Akan tetapi, jika pada pertemuan tanggal 17 Januari mendatang, RIM ternyata berniat untuk mematuhi aturan pemerintah, berarti hanya tinggal permasalahan teknis seputar filtering pornografi saja,” sebut Gatot.

Akan tetapi, Gatot menyebutkan, bila sampai tanggal 21 nanti, yang berarti periode 2 minggu yang diberikan pemerintah terhadap RIM sudah terlewati dan konten pornografi masih bisa diakses lewat BlackBerry, maka pemerintah akan melarang RIM untuk menyediakan layanan browsing.

“Hanya layanan browsing internet saja yang dilarang. Layanan seperti telepon, SMS, email, dan BlackBerry Messenger (BBM) tidak dilarang,” kata Gatot. “Kuncinya ada di tanggal 17 itu,” ucapnya
